Allstate given rehearing deadline

It's still not clear when Allstate Corp. will stop writing policies in Florida, despite an appeals court ruling.

The insurer can continue to write policies until April 14, the deadline for filing for a rehearing of a ruling by the First District Court of Appeals in Tallahassee, the court says in a clarification issued Tuesday.

If Allstate does file for a rehearing, it may continue writing policies until that rehearing is concluded.

The Florida Office of Insurance Regulation suspended Allstate from writing new business Jan. 16 after Insurance Commissioner Kevin McCarty halted a hearing into its reinsurance program, their relationships with risk modeling companies, insurance rating organizations and insurance trade associations. Allstate appealed the suspension to the courts, asserting the commissioner exceeded his authority. The court stayed the suspension until it could consider the issue, but lifted the stay, ruling on April 4 that the commissioner did not exceed his authority to suspend Allstate's licenses.

Allstate then released about 150,000 pages of documents related to a review of its claim practices in the 1990s on its Web site, though it said it still believes the documents contain trade secrets.

The state office says it is not commenting on the documents.
